Throughout
the remainder of this Agreement, the party(s) preparing to place
an order for any products/services, or who have already placed
an order for any products/services, or any person or entity
acting on the behalf of the party(s) preparing to place an order
for any products/services, or who have already placed an order
for any products/services, will be referred to as
"YOU" and any variation thereof (e.g. YOUR, YOU’RE,
etc.). myFloodZone.com, their owners, principles, officers,
directors, parent company, subsidiaries and any and all
affiliated parties, or any person or entity acting on the behalf
of myFloodZone.com will be referred to as "WE" and any
variation thereof (e.g. US, OUR, etc.). Our products/services
will be referred to as "FZD".
WE
agree to perform this FZD to the best of our abilities,
utilizing any and all sources deemed necessary to complete this
FZD, including but not limited to: NFIP and FEMA maps and/or
data, any city / county / state / federal government resources,
various mapping tools and software, real estate professionals,
etc. If WE make an error on YOUR FZD, WE will reimburse YOU the
total amount that YOU paid to US for the associated FZD unless
the error was a result from any of the following: misspelled,
inaccurate or fraudulent data enter by YOU or by anyone on YOUR
behalf -or- errors as a result of inaccurate information
provided by FEMA, NFIP, or any source deemed reliable and
necessary to complete YOUR FZD. Aside from the exclusions set
forth above, all sales are final. WE are not responsible for any
problems associated with YOU and YOUR inability to view or
otherwise access YOUR product as a result of poor computer
skills and/or compatibility issues relating to YOUR computer,
hardware, software, ISP, email server, or any other reasons
related to YOU. If you live in a community that does not
participate in the National Flood Insurance Program (NFIP) or a
community considered to be NSFHA, maps and/or data may not be
available (a map Index may be issued when available). If you
place an order for a home or property located in such a
community, we must still go through the normal research process
to reach this conclusion and therefore a refund will not be
issued. If YOU are using OUR service to dispute a previous flood
determination by a lender or mortgage holder, be advised that
they may or may not accept the findings of OUR determination.
YOU agree not to make unauthorized copies of, or redistribute in
any manner the product that YOU receive from US, to anyone,
including but not limited to friends, relatives, neighbors,
businesses, individuals or legal entities, etc. WE are not
affiliated with, nor claim to be endorsed by the Federal
Emergency Management Agency (FEMA) or The National Flood
Insurance Program (NFIP). Any Logos and/or Trademarks are the
property of the entities associated with them and were used by
permission. In all claims, cases and instances, OUR liability to
YOU will be limited to the dollar amount that YOU paid to US for
OUR products and/or services. Furthermore, YOU agree to hold US
harmless for any damages that may occur, or YOU may incur, as a
result of OUR products, services, advertising, partners,
advertisers, OUR website and it’s content.

PRIVACY POLICY
Any
and all
information that YOU provide to US will be kept confidential. WE
will not, under any circumstances, provide YOUR personal
information to another party. |
